Privacy Policy
Last updated:
This Privacy Policy describes how Tim Konieczny, Unipessoal Lda, a Portuguese Sociedade Unipessoal por Quotas operating the Rapidemo screen recording software and related services ("Company," "we," "us," or "our"), collects, uses, and discloses information about you.
We are committed to protecting your privacy and complying with the European Union's General Data Protection Regulation (GDPR).
1. Data Controller and Contact Information
Data Controller:
Tim Konieczny, Unipessoal Lda
Rua da Fontinha 11, 3° dto., 4000-243 Porto, Portugal
PT518913732
Contact Information:
For any questions regarding this Privacy Policy or to exercise your data subject rights, please contact us at:
Email: tim@getrapidemo.com
2. Information We Collect
We collect information based on how you interact with the Software and our website.
2.1. Account and Payment Information
This data is necessary to process your license purchase, activate your product, and manage your account.
- Data Collected: Name, email address, country, and licensing information (e.g., license key status).
- Purpose: Contractual necessity (fulfilling your license purchase).
- Third-Party Processor: Paddle.com Market Limited (Merchant of Record). Paddle processes your payment details (credit card information, billing address) directly. We do not store full payment details.
2.2. User Content (Optional Cloud Sharing)
If you choose to use the optional cloud sharing feature to generate a public link for your video:
- Data Collected: Your video recording (User Content).
- Purpose: Fulfillment of service (Contractual necessity, based on your explicit request).
- Data Controller/Processor Role: For this data, we act as a Data Processor on your behalf, executing your instruction to host the file for sharing.
2.3. Technical and Operational Data
(a) Crash and Issue Tracking (Sentry):
- Data Collected: Technical and diagnostic information in the event of a software crash or error (e.g., stack traces, operating system version, application version). Crucially, this data also includes your email address and account ID (if you are a licensed user) to link the crash report to your specific license and support history. No video content is included.
- Purpose: Legitimate interest (improving software stability, security, and linking specific technical issues to customer accounts for efficient support and license verification).
- Opt-Out: You can disable this reporting function at any time via a toggle in the Software settings.
(b) Analytics (Umami):
- Data Collected: We run our own instance of Umami, an open-source analytics tool, on our servers (Fly.io, London). No analytics data is shared with the Umami vendor. For each page view we record the page URL, the referrer, browser, operating system, device type, screen size, language, and the country, region and city derived from your IP address. The IP address is used only to derive that location and a pseudonymous session identifier that changes every month. It is not stored. Umami sets no cookies. We honor the Global Privacy Control signal: if your browser sends it, neither the analytics script nor the affiliate tracking script is loaded.
- Purpose: Legitimate interest (understanding general usage trends and improving the user experience).
(c) Affiliate Tracking (Tolt):
- Data Collected: Anonymous tracking identifiers (cookies/referral codes) used to attribute sales to our affiliate partners.
- Purpose: Legitimate interest (managing our business partnerships).
2.4. Testimonials You Submit
If you submit a testimonial through the form on our website, you do so on your own initiative and the form tells you what happens to it before you send it.
- Data Collected: Your name, the text you write or the video you record, and, if you provide them, your email address, job title, company, a short bio and a photo. We also record the star rating you choose and the date of submission.
- Published: Your name, your text or video, your photo, and any job title, company or bio you gave us. These appear on getrapidemo.com and may be used in our marketing, for example in a social media post or a presentation. Your email address is never published. We use it only to confirm we received your testimonial and to reach you about it.
- Purpose: Consent. You give it by submitting the form, and you can withdraw it at any time (see below). Withdrawing does not make our earlier use of it unlawful, but it does mean we stop: the testimonial comes off the website promptly, we use it in nothing new, and we take reasonable steps to remove it from material we have already published elsewhere.
- Changing or removing it: Email tim@getrapidemo.com and we will amend it or take it down. There is no self-service editing: we may lightly edit a testimonial for length or clarity, so changes go through one conversation rather than two.
- Processors: Photos and videos are stored with Tigris (object storage) and served from our own servers. Resend delivers the two emails a submission triggers.
2.5. Public Posts We Republish
Some of the testimonials on our website are public posts about Rapidemo that were published on X or LinkedIn by their authors. Where we show one, we copy the author's name, their profile picture, the text of the post and any images or video it contains, and we link back to the original.
- Purpose: Legitimate interest in showing what people publicly say about our product. We rely on the fact that the post was published publicly by its author, and we always link to the original so the context is one click away.
- If it is your post: Email tim@getrapidemo.com and we will remove it. You do not have to explain why.
3. Legal Basis for Processing (GDPR)
We process your personal data based on the following legal grounds:
| Category of Data | Legal Basis | Description |
|---|---|---|
| Account/License Information | Contractual Necessity | Processing is necessary to fulfill our contract to provide you with a license key and access to the Software. |
| Optional Cloud Video Upload | Consent / Contractual Necessity | Processing is necessary because you explicitly requested the cloud sharing service. |
| Sentry Crash Reports | Legitimate Interest | Processing is necessary to ensure the security, stability, and bug-free operation of the Software, and to provide support for licensed users. |
| Testimonials You Submit | Consent | Processing is based on the consent you give by submitting the form, which the form describes before you send it. You may withdraw it at any time. |
| Public Posts We Republish | Legitimate Interest | Processing is necessary to show what people have publicly said about our product. The data was published by its author on a public platform, and we link back to the original. |
| Umami/Tolt Analytics | Legitimate Interest | Processing is necessary for the purposes of improving our website/app and managing our business (analytics and affiliate program). |
4. Data Retention
We only retain your personal data for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.
- License/Account Data: Retained for the duration of your license, and for a period thereafter as required by Portuguese tax and legal requirements.
- Uploaded Video Content (Cloud Sharing): Retained until you manually delete the content via your account, or if we determine the content violates our Terms of Service (Section 4.5).
- Testimonials: Retained for as long as we show the testimonial, and afterwards only as a record that it was given and later withdrawn. Ask us to delete it outright and we will. Uploads that were started but never submitted are deleted automatically within two days.
- Anti-Spam Records: Our forms count recent submissions per IP address so that a single sender cannot flood them. These counters hold the IP address for at most 24 hours and are then deleted.
- Sentry Crash Reports: Generally retained for a short period (e.g., 90 days) to diagnose and fix errors, after which they are aggregated or deleted.
- Umami Analytics: Retained in pseudonymized form for as long as we operate the website, so that long-term trends can be compared.
5. International Data Transfers
As our company is based in Portugal (EU), we primarily operate under EU data protection standards. However, some of our third-party processors (such as Sentry, Resend, and the object storage that holds uploaded videos and testimonial media) may be located outside of the European Economic Area (EEA), including the United States.
When data is transferred outside the EEA, we ensure a similar degree of protection is afforded by implementing appropriate safeguards, such as reliance on adequacy decisions or using Standard Contractual Clauses (SCCs) approved by the European Commission.
6. Your Data Protection Rights (GDPR)
Under the GDPR, you have the following rights regarding your personal data:
- Right of Access: The right to request copies of your personal data.
- Right to Rectification: The right to request that we correct any information you believe is inaccurate or incomplete.
- Right to Erasure ('Right to be Forgotten'): The right to request that we erase your personal data under certain conditions.
- Right to Restrict Processing: The right to request that we restrict the processing of your personal data, under certain conditions.
- Right to Object to Processing: The right to object to our processing of your personal data (where the basis is legitimate interest).
- Right to Data Portability: The right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions.
- Right to Lodge a Complaint: You have the right to lodge a complaint with the Portuguese supervisory authority (Comissão Nacional de Proteção de Dados - CNPD) if you believe we have not handled your data properly.
To exercise any of these rights, please contact us at the email address provided in Section 1.
7. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will notify you of any material changes by updating the "Last Updated" date at the top of this policy. We encourage you to review this policy periodically.
